General:
WITH-IT TUTORS LLP is an agent for Tutors. It provides introductions of Tutors to Clients and vice versa.
An opinion expressed by a Tutor is not necessarily an opinion held by WITH-IT TUTORS LLP.
These terms and conditions govern the relationship between Client, Tutor, and WITH-IT TUTORS LLP, and WITH-IT TUTORS LLP reserves the right to alter these terms and conditions. No variation or alteration of these terms and conditions shall be valid unless approved in writing by a Partner of WITH-IT TUTORS LLP. Use of our services will be taken to represent agreement to these Terms and Conditions.
Client Terms and Conditions:
Use of our services will be taken to represent agreement to these Terms and Conditions.
Outline of how we work:
WITH-IT TUTORS LLP acts as an agency between Client and Tutor. The primary point of contact between the Client and WITH-IT TUTORS LLP will be through the Partner/s responsible for processing the new Client proposal, providing the Client with Tutor options to choose from, overseeing the continued provision of excellent services by the Tutor and being the primary point of contact between the Client and the Tutor if required.
The Client can contact a Partner at any time via email/whatsapp when requesting content.
When a Tutor accepts the opportunity to work with a Client, the Tutor Information will be passed on to the Client in an Introduction email set up by a Partner in charge of managing that particular Client.
Fees and Payment:
For our tuition services, Clients are invoiced on the working day nearest to the 28th of each month for the lessons booked for the upcoming month. The Client can freely book more lessons in a given month and will be invoiced on the following month’s invoices. The first month's invoice will be issued after the initial free session, irrespective of the session date, if the client chooses to continue with WITH-IT TUTORS LLP. Payment is made via bank transfer to our account. For Clients with non-UK accounts, IBAN and BIC details are available upon request.
Payments must be made to WITH-IT TUTORS LLP within 10 days of the date of the invoice.
If any sums remain unpaid for 10 days, WITH-IT TUTORS LLP will initially send the Client 1 reminder letter per week until such sums are paid. The client is then fined £10 for admin costs of sending each letter. While tuition fees are agreed in advance between WITH-IT TUTORS LLP and the Client, WITH-IT TUTORS LLP reserves the right to change the tuition rates at any time, provided reasonable notice has been given to the Client.
Weekly payments plans:
If the client is paying in weekly installments then payment must be made at least the day before your scheduled lesson to confirm your booking
Referrals:
If an existing client refers a new student who is not currently receiving tutoring services from WITH-IT TUTORS LLP, and the referred student continues to receive tutoring services from WITH-IT TUTORS LLP following their initial free trial session, the following rewards will apply:
a. The referring client will receive a £24 discount on their next invoice of £24 or more.
b. The referred student will also receive a £24 discount on their next invoice of £24 or more.
Non-solicitation:
The billing process will be under the control of WITH-IT TUTORS LLP. All bookings of our tutors and payments for any of our services are to be undertaken only through WITH-IT TUTORS LLP, and the Client is not to agree to any alternative fees with the Tutor and is not to pay Tutors directly.
A breach of these terms will render the Client liable to account to WITH-IT TUTORS LLP for all sums received by the Tutor directly from the Client or from a new Client without deduction and WITH-IT TUTORS LLP shall be entitled to seek injunctions against the Client to prevent further breaches. These obligations continue beyond the termination or conclusion of this agreement.
If you are looking to recommend a Tutor from WITH-IT TUTORS LLP to another potential Client, then this recommendation and booking must also take place through WITH-IT TUTORS LLP.
Expenses:
Any additional expenses such as textbooks and travel expenses must be agreed with the Client before invoicing. We recommend that the Client buys on their own any material for the lessons (recommended by the Tutor).
Clients should not make direct payments to the Tutor, instead all payments should come through WITH-IT TUTORS LLP, and the Client will be invoiced for any additional expenses on the first day of each month for the expenses due from the preceding month.
Liability:
WITH-IT TUTORS LLP does not accept any liability for any claims by the Client arising out of or related to the carrying out of the Tutoring by a Tutor introduced by WITH-IT TUTORS LLP.
WITH-IT TUTORS LLP is not liable for any loss, expense, damage, or delay arising from the negligence, dishonesty, misconduct, accidental or deliberate damage to property during the assignment, or lack of skills of the tutor. We conduct enhanced DBS checks on all tutors to ensure they are fit for tutoring, and thus, we are not to be held liable for a tutor's negligence or faults.
WITH-IT TUTORS LLP is not liable for outcomes of tutoring, including but not limited to exam results, entrance tests, and dissertation scores.
Late Arrivals Policy:
If a student arrives late to a scheduled session, the lesson will still end at the originally scheduled time.
This policy ensures fairness to all clients and respects the time commitments of our tutors and other scheduled lessons.
If the tutor arrives late and the session cannot be extended, then WITH-IT TUTORS LLP will refund the lesson time missed.
Cancellation Policy:
Both the client and the tutor must notify the other in advance of any holiday commitments they may have, including but not limited to holiday, illness, and adverse weather conditions that prevent access.
A 6-hour cancellation notice of any session must be given by the client. WITH-IT TUTORS LLP charges them if they cancel the lesson, unless there are mitigating circumstances.
If the student terminates a lesson early, the lesson will be charged at the usual price.
Cancellations by the client of more than 3 weeks in succession, or those which WITH-IT TUTORS LLP perceives as unreasonable, regular cancellations, will be considered for immediate termination of the contract, at WITH-IT TUTORS LLP's discretion.
Termination of Tuition:
A tutor can terminate tuition with a client with 2 weeks of notice. This period is in place to allow WITH-IT TUTORS LLP to find a replacement tutor, if required. WITH-IT TUTORS LLP has the right to waive the 2-week notice period if it is felt that this would be in the best interest of both the tutor and the client.
Data Protection:
WITH-IT TUTORS LLP is registered under the Data Protection Act to hold and use client data for the purposes of the services that it provides. Clients providing personal data to WITH-IT TUTORS LLP are consenting to the use of that data by WITH-IT TUTORS LLP for the purpose of effecting introductions to tutors, for billing and fee collecting purposes, and to enable WITH-IT TUTORS LLP to contact the client/student from time to time. Where required for legitimate purposes in connection with WITH-IT TUTORS LLP's business and subject to suitable safeguards, that data may be transferred to others.
Confidentiality:
The client agrees that they will not disclose any confidential information concerning the tutor or WITH-IT TUTORS LLP to any person for the duration of this agreement and for a period of five years after the termination of the agreement, save as required by law, a court order, or any governmental or regulatory authority.
